CHECKLESS TERMS OF SERVICE

Welcome to Checkless ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, services, and payment systems (collectively, the "Platform").
By using Checkless, you agree to these Terms. If you do not agree, do not use the Platform.
1. Acceptance of Terms
By accessing or using Checkless, you:
- Acknowledge you have read, understood, and agree to these Terms.
- If you are a parent or legal guardian, you accept responsibility for any minors using Checkless under your account.
- Acknowledge that Checkless is not responsible for any transactions, disputes, or actions resulting from your use of the Platform.
2. Eligibility & Account Registration
- There is no minimum age requirement, but users under 18 years old must have a parent or guardian linked to their account.
- You are responsible for all activity on your account, including charges incurred.
- Checkless reserves the right to suspend or terminate accounts at any time, for any reason, without notice.
Account Security:
- You are responsible for maintaining the confidentiality of your account and payment information.
- Any unauthorized access must be reported immediately to Checkless.
3. Payment Processing & Charges
By using Checkless, you agree to the following payment terms:
Automatic Payments:
- When you dine at a participating restaurant, Checkless will automatically charge your linked payment method.
- If you fail to have sufficient funds, we may attempt to charge you again or recover unpaid balances through alternative means.
Bill Splitting:
- Users may split bills with other Checkless users before a transaction is finalized.
- If a split payment is not completed, the original user remains fully responsible for the charge.
Chargebacks & Disputes:
- If you initiate a chargeback, Checkless reserves the right to restrict, suspend, or terminate your account.
- All disputes must first be handled through Checkless before contacting your bank or card provider.
4. Restaurant & Business Terms
Restaurants using Checkless agree to the following:
- Checkless is not liable for lost revenue, chargebacks, or disputes.
- Payouts to restaurants are made according to Checkless's internal schedule, and delays may occur.
- Guaranteed Payments: If a Checkless user dines and fails to pay, Checkless will cover the transaction—this does not apply to non-Checkless users.
- Restaurant pricing, menu availability, and service quality are the sole responsibility of the restaurant.
5. Refunds & Cancellations
- All sales are final unless explicitly stated otherwise by the restaurant.
- Refund requests must be made directly to the restaurant. Checkless is not responsible for meal dissatisfaction, service complaints, or incorrect charges.
- In cases of fraudulent charges, users must report the issue within 72 hours for possible resolution.
6. Prohibited Conduct
By using Checkless, you agree not to:
- Tamper with the Platform, hack, or attempt unauthorized access.
- Abuse bill-splitting features (e.g., attempting to offload charges onto another user without consent).
- Engage in fraudulent, abusive, or illegal activity related to payments or restaurant interactions.
- Attempt to reverse-engineer or exploit Checkless software, APIs, or payment infrastructure.
- Create multiple accounts to bypass system rules, payment obligations, or restrictions.
Checkless reserves the right to investigate and take appropriate action against users violating these Terms.
7. Liability & Disclaimers
Checkless is a payment facilitator, not a restaurant, service provider, or merchant.
We do not guarantee food quality, restaurant service, or the accuracy of pricing and menu items.
Limitation of Liability:
- Checkless, its affiliates, employees, and partners shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, incorrect charges, data loss, or system failures.
- Checkless's maximum liability in any claim shall not exceed the amount paid by the user for the disputed transaction.
8. Termination & Account Suspension
We may suspend, restrict, or terminate your account under the following conditions:
- Failure to pay outstanding balances.
- Repeated chargebacks or fraudulent activity.
- Violation of any provision in these Terms.
- Engaging in abusive or harmful behavior toward restaurants, staff, or Checkless support teams.
If your account is terminated, you may not create another account without our permission.
9. Changes to These Terms
Checkless reserves the right to modify or update these Terms at any time. Changes will take effect immediately upon posting to our website or app. Continued use of Checkless after changes are posted constitutes acceptance of the new Terms.
10. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by the laws of California.
Dispute Resolution:
- All disputes must first be handled through Checkless support.
- If unresolved, disputes shall be settled via binding arbitration in San Francisco, California.
- Users waive their right to participate in class-action lawsuits against Checkless.
